Terms and Conditions of Tejada Baseball Club.

1. Introduction and Acceptance

These Terms and Conditions (“Terms”) govern the access and use of the website https://tejadabaseballclub.com, the mobile application (together, the “Platform”), and the physical facilities of Tejada Baseball Club., including batting cages and pitching practice areas (collectively, the “Facilities”).

By accessing or using the Platform or the Facilities, you (“User”) agree to be bound by these Terms. If you do not agree, you must not use our Services.

2. Eligibility

  • You must be at least 18 years old to register and make reservations.
  • Minors may only use the Facilities under the direct supervision of a parent or legal guardian who accepts these Terms on their behalf.
  • You represent that you are physically and medically fit to participate in baseball activities, and you release Tejada Baseball Club from any liability related to pre-existing medical conditions or injuries sustained while using our Services.

3. Use of Facilities

By using our Facilities, you and your guests agree to:

  • Wear helmets and protective gear at all times inside batting cages and pitching areas.
  • Follow the instructions of Tejada Baseball Club staff at all times.
  • Refrain from consuming alcohol, drugs, or prohibited substances within the Facilities.
  • Maintain respectful and safe behavior toward other participants and staff.
  • Not use the Facilities for unauthorized purposes (including but not limited to gambling, violence, or sexual activity).
  • Be financially responsible for any damage to equipment, pitching machines, nets, or property caused by misuse or negligence.

Tejada Baseball Club reserves the right to immediately remove any individual from the Facilities for violating these rules, without refund.

4. Use of the Platform

  • You are responsible for the accuracy of the information provided upon registration.
  • You agree not to:
    • Use the Platform for fraudulent, unlawful, or unauthorized commercial purposes.
    • Interfere with the proper functioning of the website, mobile app, or booking systems.
    • Share your login credentials with unauthorized third parties.

5. Personal Belongings

Tejada Baseball Club is not responsible for the loss, theft, or damage of personal property within the Facilities. Users are encouraged not to leave valuables unattended.

6. Reservations, Payments, and Cancellations

  • All reservations must be made through the Platform or at the reception desk.
  • Cancellations must be made with at least 24 hours’ notice.
  • No refunds will be issued for late arrivals, no-shows, or rule violations resulting in removal.
  • Tejada Baseball Club may cancel reservations in cases of force majeure (e.g., maintenance, technical failures, extreme weather). In such cases, reservations may be rescheduled at no additional cost.

7. Assumption of Risk and Liability Waiver

By using our Services, you acknowledge and agree that:

  • Participation in baseball-related activities (batting, pitching, training) involves inherent risks of injury.
  • You voluntarily assume full responsibility for all risks associated with participation and release Tejada Baseball Club, its owners, coaches, and employees from any liability for accidents, injuries, losses, or damages, except where caused by gross negligence or willful misconduct.
  • You are responsible for the safety of any minors or guests under your supervision.
  • You agree to indemnify and hold harmless Tejada Baseball Club from any claims, damages, costs, or legal fees arising from your breach of these Terms or misuse of the Services.

8. Prohibited Conduct

Any abusive, violent, discriminatory, or unlawful conduct will result in immediate removal from the Facilities, termination of account access, and possible notification to law enforcement authorities.

9. Modifications

Tejada Baseball Club reserves the right to modify these Terms at any time by posting the updated version on the Platform. Continued use of the Services after modifications constitutes acceptance of the revised Terms.

10. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the state in which Tejada Baseball Club operates its physical Facilities. Any disputes shall be submitted to the exclusive jurisdiction of the competent courts in that state.
